I remember reading about an interesting experience Geoffrey Bennett had with
Toshiba on this very subject. He documented the full saga here:

It's a very worth while read and illustrates that the standard party line of
"if you don't agree to the EULA, just return the software and we'll refund
your money", is all well and good up until the point where you actually try
to get your refund!
