IF the phone converstaions were "rebroadcast from here to say, overseas then
YES the person retransmitting the phone call here is breaking australian law...
whether the person at the other end is committing an offence in his/her country
would depend on their laws...
Conversely, if the retransmissions were coming from outside australia then
whilst it may not be illegal for the person overseas to retransmit the phone
call... it would be illegal for the person hear to listen.... its a very grey
area in places..
We have a similar situation with allowing amateur radio operators using the
Radio TCPIP Internet/Amprnet network into the Internet & vice versa..
In australia our licence conditions do NOT permit us to allow non licenced
persons to access the amateur radio portion of internet or vice versa...whereas
such things happen frequently in say the USA where some of there rules are less
stringent/rigid... no-one in australia has been
taken to court yet BUT no-one wants to be the test case so here in australia
we block internetters from being able to access our tcpip networks & vice
versa!!
There are heaps of amateur radio related sites on the internet.. but the actual
amateur radio tcpip part of the internet is blocked against intruders.
